These Terms & Conditions of Use (“Terms”) govern your access to and use of the BeautyODM website (the “Platform”). By accessing, browsing, or using the Platform, you agree to be bound by these Terms and all applicable laws and regulations. If you do not accept these Terms, you must discontinue use of the Platform immediately.
For purposes of these Terms:
“BeautyODM” refers to the platform operator providing informational and sourcing services.
“User” refers to any individual, company, or entity accessing or using the Platform.
“Supplier” refers to third-party manufacturers, retailers, or distributors listed on the Platform.
“Content” refers to all text, data, images, graphics, listings, comments, links, and other materials displayed on the Platform.
“Services” refers to sourcing tools, supplier listings, product information, and related informational services provided by BeautyODM.
BeautyODM is not a seller and does not conduct commercial transactions.
BeautyODM is a neutral, independent, technology-driven information platform designed to:
Publish product and supplier information
Facilitate communication between Users and Suppliers
Provide research tools, industry insights, and sourcing assistance
BeautyODM does NOT:
Sell any products
Process payments
Ship or deliver goods
Provide warranties
Arrange logistics or customs clearance
Conduct quality inspections
Hold inventory or operate warehouses
Act as an agent, broker, representative, or guarantor for any Supplier
All transactions, negotiations, and agreements are conducted directly between the User and the Supplier, without involvement by BeautyODM.
Nothing in these Terms shall be construed to create:
an agency relationship,
a partnership,
a joint venture,
an employment relationship, or
a fiduciary duty
between BeautyODM and any User or Supplier.
Users acknowledge that:
BeautyODM does not represent the Supplier
BeautyODM does not represent the User
BeautyODM does not endorse any product, claim, or representation
By using the Platform, you agree to:
Provide accurate and truthful information
Use the Platform for lawful purposes only
Conduct your own due diligence before engaging any Supplier
Not attempt to mislead, impersonate, or defraud others
Not engage in commercial data scraping, mining, or automated extraction
Not upload harmful code, malware, or malicious scripts
Not interfere with the operation, security, or performance of the Platform
Not submit spam, false reviews, or deceptive content
Violation of these obligations may result in suspension or permanent termination of access.
All product information, certifications, specifications, images, pricing, and descriptions are provided by third-party Suppliers.
BeautyODM:
does not verify the accuracy of Supplier claims
does not guarantee availability, compliance, or performance
is not liable for any misrepresentation
does not confirm manufacturing capacity, licensing, or legitimacy
Users agree to independently confirm:
product quality and compliance
regulatory certifications (CE, FDA, ISO, RoHS, etc.)
pricing, payment terms, production timelines
shipping arrangements and customs responsibilities
All reliance on Supplier information is at the User’s sole risk.
Any purchase, agreement, dispute, negotiation, refund request, or logistics issue arising between a User and a Supplier constitutes a separate, private commercial relationship to which BeautyODM is not a party.
BeautyODM does not:
mediate disputes
guarantee performance of either party
provide refunds
provide return management
enforce Supplier obligations
intervene in payment disputes
Users must resolve all commercial matters directly with the Supplier.
To the fullest extent permitted by applicable law:
direct, indirect, incidental, consequential, punitive, or exemplary damages
loss of revenue, profits, data, or business opportunities
claims arising from misinformation or inaccurate listings
product defects, safety issues, recalls, or non-compliance
delays, delivery failures, or customs seizures
fraudulent or unethical conduct by third-party Suppliers
viruses, system failures, or data breaches not caused by gross negligence
any reliance placed on information provided on the Platform
BeautyODM’s total liability, if any, shall be limited to the amount paid by the User to access the Platform, which is typically zero unless the User has purchased premium services.
Unless otherwise noted, all Content on the Platform is owned by or licensed to BeautyODM.
Users must not:
copy, modify, distribute, or publish Platform Content
reproduce the platform’s design or layouts
use BeautyODM trademarks without written consent
Permitted use is limited to personal, informational, non-commercial purposes.
Use of the Platform is governed by BeautyODM’s Privacy Policy, which complies with:
GDPR (European Union)
CCPA (California Consumer Privacy Act)
Applicable international privacy regulations
By using the Platform, Users consent to data handling practices described in the Privacy Policy.
BeautyODM may suspend or permanently terminate access without notice if:
the User violates these Terms
fraudulent or harmful activity is detected
the User abuses the Platform or infrastructure
required by law, court order, or regulatory authority
Termination does not limit BeautyODM’s right to pursue legal remedies.
The User agrees to indemnify, defend, and hold harmless BeautyODM and its affiliates, officers, employees, and partners from any claims, losses, damages, liabilities, or expenses arising from:
misuse of the Platform
violations of these Terms
disputes with Suppliers
breach of laws or third-party rights
These Terms shall be governed by the laws of the jurisdiction in which BeautyODM operates, without regard to conflict-of-law principles.
Users agree to submit to the exclusive jurisdiction of the courts located in that jurisdiction.
BeautyODM may modify these Terms at any time. Updates become effective immediately upon publication on this page.
Continued use of the Platform constitutes acceptance of the revised Terms.
